По Конституции Президент США [ President, U.S.] и Конгресс [ Congress, U.S.] имеют право объявить призыв в случае войны или при чрезвычайном положении в стране. В мирное время воинские контингенты формируются на добровольной основе. Но даже во время войны призыв осуществлялся преимущественно в Сухопутные силы [ Army, U.S.], а ВМФ [ Navy, U.S.] и ВВС [ Air Force, U.S.] формировались главным образом как профессиональные силы. В период подготовки Конституции ее создатели предполагали, что милиция штатов [ militia] (прообраз Национальной гвардии [ National Guard]) является достаточной основой для создания регулярной армии, и потому в основном законе не упоминается воинская повинность. Существует предание, что на Конституционном Конвенте [ Constitutional Convention] один из делегатов даже предложил, чтобы численность американской армии никогда не превышала 5 тыс. человек, на что Дж.
